ZooZoom.lv Terms of Use
Definitions
Terms and Conditions – these Terms of Use, their additions and amendments, which are published on the website of the online store ZooZoom.lv and determine the procedure for the use of the online store.
Seller – SIA “Biomill”, registration No. 40103263538, legal address: Irbju street 30, Jurmala, LV-2100, phone: +371 20922263, e-mail: zoozoomlv@gmail.com.
Buyer – a natural or legal person who places an order in the online store and purchases goods.
Online store – an online store ZooZoom.lv available at the address www.zoodev.lionssolution.com where the Buyer can choose, order and purchase goods remotely.
Goods – pet food, delicacies, complementary food, hygiene products, toys, accessories, care products and other pet goods available in the online store.
Product price – the price indicated next to the specific product at the time of placing the order. The price does not include shipping costs, unless otherwise stated.
Order – a purchase made in the Buyer’s online store, which indicates the selected goods, the method of delivery and other necessary information for the execution of the order.
Shopping cart – a virtual environment in the online store, where the Buyer adds the selected goods before placing an order.
Registered user – the Buyer who has created a user account in the online store.
Grower Program Participant – a registered user who has joined the Growers Program in accordance with the procedure established in ZooZoom.lv and can receive special offers and benefits.
Order acceptance – an automatic notification confirming that the order has been received for processing.
Order confirmation – Seller’s confirmation that the order has been completed and prepared for shipment.
Distance contract – a contract between the Buyer and the Seller concluded remotely using the online store ZooZoom.lv.
Right of withdrawal – the right of the consumer to withdraw from the purchase within 14 days from the date of receipt of the goods in accordance with the procedures laid down in the laws and regulations of the Republic of Latvia.
1. GENERAL PROVISIONS
1.1. These Terms determine the legal relationship between the Seller and the Buyer when purchasing goods in the online store ZooZoom.lv, as well as regulate the operation of the Breeders’ Program.
1.2. The Terms and Conditions have been developed in accordance with the laws and regulations of the Republic of Latvia.
1.3. The Seller has the right to amend these Terms at any time. The changes take effect after their publication in the online store.
1.4. Orders placed before the publication of the amendments shall be subject to the version of the Terms and Conditions that was in force at the time of placing the order.
1.5. The seller has the right to change the prices of the goods without prior notice. The buyer is bound by the price indicated at the time of placing the order.
1.6. The buyer can place orders both as a registered user and without registration.
1.7. By registering in the online store, the Buyer undertakes to provide true and up-to-date information.
1.8. The buyer can join the Breeders Program and receive special offers according to the conditions of the program.
1.9. Personal data is processed in accordance with the Privacy Policy.
1.10. It is forbidden to use automated data mining tools, enter malicious software or perform activities that may threaten the operation of the site.
1.11. The Seller has the right to restrict access to the user account if violations of these Terms are detected.
1.12. The seller has the right to apply to the competent authorities for the protection of his interests.
2. DISTANCE CONTRACT
2.1. Orders in the online store can be made by natural and legal persons with legal capacity.
2.2. By placing an order, the Buyer confirms that he has read these Terms.
2.3. The distance contract is considered concluded at the moment when the Seller sends the order confirmation to the e-mail address specified by the Buyer.
2.4. The distance contract is valid until all obligations are fully fulfilled.
3. CATALOGUE OF GOODS AND PRICES
3.1. Images of goods have an illustrative meaning.
3.2. All information published in the online store is the property of the Seller or its cooperation partners.
3.3. Copying or use of content without written permission is prohibited.
3.4. All prices are in euro (€) and include VAT.
3.5. Delivery costs are calculated separately at the time of placing the order.
4. ORDER PROCESSING AND PAYMENT
4.1. The buyer selects the goods, adds them to the shopping cart and fills in the necessary information.
4.2. The buyer is responsible for the correctness of the information provided.
4.3. The order is considered submitted after its confirmation and payment.
4.4. The seller sends a confirmation of receipt of the order to the e-mail.
4.5. Payments are made with the payment methods available in the online store.
4.6. If payment is not received, the order may be cancelled.
5. DELIVERY AND EXECUTION OF THE ORDER
5.1. After receiving the payment, the Seller starts assembling the order.
5.2. If any product is not available, the Seller contacts the Buyer about a possible solution.
5.3. The invoice is prepared electronically and is valid without a signature.
5.4. Information about sending the order is sent to e-mail.
5.5. Upon receipt of the order, the Buyer must check the condition of the goods.
5.6. The Seller must be immediately informed of any damage or discrepancies.
5.7. An unclaimed order may be returned to the Seller.
6. CONSULTATIONS ON GOODS AND ORDERS
6.1. Buyers can get advice on goods, orders and pet care products.

7. WARRANTY AND RIGHT OF WITHDRAWAL
7.1. The consumer has the right to exercise the right of withdrawal within 14 days from the date of receipt of the goods.
7.2. In order to exercise the right of withdrawal, the Buyer sends a notification to the zoozoomlv@gmail.com.
7.3. The product must be returned within 14 days after the notification of the refusal.
7.4. The product must be unused and in its original packaging.
7.5. The right of withdrawal may not be used for open feed, delicacies, complementary feed, hygiene products and other goods which cannot be remarketed for health or hygiene reasons.
7.6. Refund is made within 14 days after receipt of the product.
8. PROCESSING OF PERSONAL DATA
8.1. The controller of personal data is SIA “Biomill”.
8.2. Personal data is processed for the fulfillment of orders, customer service and fulfillment of obligations specified in regulatory enactments.
8.3. The buyer may be asked to provide the name, surname, e-mail, telephone and delivery address.
8.4. The processing of personal data is carried out in accordance with the GDPR and the regulatory enactments of the Republic of Latvia.

9. LIMITATION OF LIABILITY
9.1. The seller is not liable for losses incurred as a result of improper use of the goods.
9.2. The seller shall not be liable for delays in delivery caused by third parties or force majeure.
9.3. The Buyer is liable for damages incurred as a result of violation of these Terms.
10. DISPUTE RESOLUTION
10.1. Disputes between the Buyer and the Seller are first resolved through negotiations.
10.2. If it is not possible to reach an agreement, the dispute shall be resolved in accordance with the procedures laid down in the laws and regulations of the Republic of Latvia.
10.3. The consumer is entitled to apply to the Consumer Rights Protection Centre or the competent court.
FINAL PROVISIONS
These Terms of Use come into force from the moment of their publication in the online store ZooZoom.lv.
